BOARD OF SUPERVISORS MINUTES

The Conewago Township Board of Supervisors held their regular meeting Wednesday, September 10, 2003. Those present were:

The meeting was called to order by Chairman Graybill at 7:30 pm.

MINUTES OF AUGUST 13, 2003 - A motion by Rochat second by Graybill to table August 13, 2003 minutes to correct the waivers for Dr. Sicher's Plan. Motion carried.

TREASURER'S REPORT - AUGUST 31, 2003 - A motion by Rochat second by Graybill to approve the Treasurer's Reported dated August 31, 2003, subject to audit. Motion carried.

EXPENDITURE REPORT - SEPTEMBER 10, 2003 - A motion by Graybill second by Rochat to approve the expenditure report dated September 10, 2003 in the amount of $35,176.73, but to hold Check No. 4038, ACR for painting township building until Brandt approves. Motion carried.

SUBDIVISION/ENGINEERING FEES - Billing all up-to-date

PLANNING COMMISSION MINUTES - AUGUST 25, 2003 - For review only.

PUBLIC COMMENT PERIOD - LT. BARKDOLL, TROOP H - He is the Crime Section Commander and stated the State police are moving in a new direction with technology. The new commissioner, Jeff Miller is devoted to having all incidents computerized pertaining to collison, criminal related information and that information will be entered in the computer by latitude and longitude and will pinpoint areas where most crimes take place. Lt.Barkdoll encouraged residents to go on line because there is a lot of information available such as a telephone directory, crime history reports and most recent they have a press program called PA Criminal Intelligence Committee, which is available 24 hours. They meet on regular basis with local, state, federal and other groups of law enforcements agencies. He dropped off name cards for terrorist threats and who to call if you see anything suspicious. In February, 2004 the state police barrick off of Rt.39 and Rt. 22 will have a central dispatch for multi-county dispatch.

JANE HAFER - Is Ridge Road maintained by township or state? It is maintained by the township and she wants to know when the repairs marked off to be done will be finished. She walks along that road, and it is not safe to walk where it is broken. Brandt will check with maintenance workers to see what can be done. A she also stated that on Roundtop Road, at Hills of Waterfordthere is a manhole that is raised and asked this will be repaired. The Board stated a portion of road will be replaced when project is finished.

PROPERTY MAINTENANCE ORDINANCE - NO PROGRESS

STATUS REPORT - DTMA - Kim Bloom said the contractor is doing very well. The work is all the way up to Church Road Pump Station and up to Nye Road and when they are finished they will do temporary paving. Work will continue in Laurel Woods. All of the right-of-ways are completed. The second crew will return to Roundtop Rd toward Church at Roundtop Road intersection until end. DTMA will have a job conference on September 11, 2003 with the contractor. They have contacted Lower Dauphin & Hershey school busses that next detour will be on Roundtop Road, but the school busses are not detoured. They haven't had any complaints lately.

The contractor is definitely on schedule. The 4 or 5 residents in Laurel Woods who need grinder pumps need to contact their plumber for prices. This is between the homeowner, plumber and Mazzuca if they can be ordered at a special price. The three pump stations, Woodbine, Church, and Roundtop will probably start after Jan, 2004 after main lines are in. Kim Bloom will send out paperwork for grant applications in October, 2003 and they should be returned to DTMA.

OLDS MANAGEMENT PROGRAM - We only have 6 residents for Year 2001 and Year 2002, who have not complied to the sewage inspection/pumping reports. The solicitor will send letters before the October meeting, and if they don't responsd to that correspondence it will than go to the District Justice. Kevin Baker, Jim's Super Vac, called the office pertaining to John Risser, his house is in Lebanon County and his Sand Mound is in Conewago. Mr. Baker didn't feel comfortable doing an inspection/pumping just in Conewago and not in Lebanon. The secretary found issued from our Conewago Township. The solicitor will send a letter stating that he has to comply with our township, which would mean doing the house in Lebanon County.

SEXUALLY ORIENTED BUSINESS ORDINANCE - The zoning officer provided a copy of Sexually Oriented Business Ordinance, which included Rochat's comments to be reviewed by him and the solicitor. The next meeting they will decide which direction they want to go. The licensing would be an amendment to Townships Codified Ordinance, Zoning ordinance would be sent to Dauphin County Planning for review prior to public hearing.

KOSER BUILDING EXPANSION - Land Development Plan Waiver, 523 Koser Road, Elizabethtown

The Koser's are proposing to build an addition to a present commercial building which is presently used for storage for public auctions. The new addition will be used for office space and more storage (Currently items are stored outside which will be moved inside the new building). A Land Development Plan Waiver is being requested. The planning commission recommended to deny the Land Development Plan Waiver and request a Land Development Plan to be submitted and meet the current Land Development Ordinance. Beginning of August Koser submitted a plan for 7800 sq. ft. to be added to existing building. They would be glad to show what was in existence at this site when the adoption of ordinances were effective. They are creating more storage for auction sales, which does not impact parking, sewage, or stormwater, etc. and would like to agree and handle this situtation outside of a Land Development Plan process.

A motion by Brandt second by Graybill to grant waiver of Land Development Plan for Koser Plan and should show on Building Permit all outside storage, floodplain in place when Ordinance was adopted 1985. A recommendation that they don't have to retain water, because of it's location it should go right to the stream, subject to engineer and zoning review, and that Koser will pay engineering fees for review. 2-Yes , Rochat-No. Motion carried.

PENNS VALLEY - UPDATE CODE OF ORDINANCE - Penn's Valley called the township office regarding updating Code of Ordinances. The Board directed the secretary to send the copies to Penn's Valley for estimate,and if we should proceed now or wait another year or so.

NEW FAX MACHINE - The Board advised the secretary to purchase a new fax machine after all the rolls of fax paper are used, and replace it with a fax machine that prints on regular paper.

ENGINEERS COMMENTS - HILL OF WATERFORD - The Plan is not recorded yet but, they supplied a letter of credit for $1,245,000. They proceeded with construction and submitted a request for a reduction of bond to letter of credit based upon completion of issues to date. (Such as grading of right-of-ways, E & S pond, inlet is in, end walls, l80 ft. of pipe and silk fence). The engineer recommended a reduction of bond in the amount of $59,881.50. A motion by Rochat second by Graybill to authorize the engineers upon receipt of engineer's letter to reduce bond for Hills of Waterford in the amount of $59,881.50. Motion carried.

ENGINEERS COMMENTS - UPDATE ON SHELLY PROPERTY TESTING - The engineer said there is no contaminations and he has a permit for driveway and was assured by Dauphin Co. Conservation that E & S is satisfactory.

ZONING COMMENTS - Scott Nye's Complaint about Neighbor's ATV Vehicles - The zoning officer sent a letter to him indicating that at this time the township does not have an ordinance in place to take any enforcement against his neighbor. Mr. Nye said Candytown closed down and he feels there may be more people using the track. The zoning officer told him to keep a watch to make sure its doesn't turn into a club, should only be used for family and friends, and if anything happens to notify the township. Rochat mentioned that at last meeting zoning office supplied a zoning ordinance pertaining to ATV vehicles and that the Board should review it.

Also zoning officer mentioned a review of a permit brought up dedication of right-of-way to township. If township never takes over really the resident can say that is their property. Secretary will put on agenda for next month's meeting - Acceptance of Dedication of Right-of-Way. The zoning officer told the Board to think about it and possibly adopt as a policy or maybe amending subdivision land development ordinance and possibly require a deed of dedication to township. The solicitor said we should go back 10 to 15 years and when a situation comes up pass resolution.

Brandt asked the Board for authorization to advertise to replace Salt Shed.

A motion by Chairman Graybill second by Rochat to adjourn at 9:39PM. The next meeting is October 8, 2002.
